The "Faded Red" Legal Loophole
In the UK, for a speed limit to be mandatory (legally enforceable), it must be displayed in a red circle.
• The "Adequate Guidance" Rule: Under the Road Traffic Regulation Act 1984, the local council has a legal duty to maintain signs so they provide "adequate guidance" to drivers.
• Invalid Signs: If a sign has faded so much that the red is gone or the number is illegible, a driver could technically argue in court that they weren't given "adequate guidance". However, if the sign on the opposite side of the road is perfectly clear, a judge would likely argue you should have known the limit.
