ලීසිං වාරික ගෙවීම් පමාවෙලාද?
වත්මන් ආර්ථික තත්ත්වය හමුවේ වාහන ලීසිං වාරික නිසි කලට ගෙවා ගැනීමට නොහැකිව බොහෝ දෙනෙක් දැඩි පීඩනයකට ලක්ව සිටිති. වාරික කිහිපයක් පමාවූ සැනින් ලීසිං සමාගම් විසින් ක්ෂණිකව වාහනය පවරා ගනීවි යැයි පවතින බිය ඉන් ප්රධාන වේ.
නමුදු, ශ්රී ලංකාවේ පවතින නීතියට අනුව, ලීසිං ගිවිසුමක් අවලංගු කිරීමට හෝ වාහනයක් පවරා ගැනීමට පෙර ලීසිං සමාගමක් විසින් අනුගමනය කළ යුතු අනිවාර්ය ව්යවස්ථාපිත පියවරයන් පවතින බව ඔබ දන්නවාද?
මේ සම්බන්ධයෙන් පවතින ප්රධානතම නීතිමය ප්රතිපාදන ඇතුළත් වන්නේ 2000 අංක 56 දරන Finance Leasing පනතේ 20 සහ 21 වන වගන්තිවලයි. ශ්රී ලංකා ශ්රේෂ්ඨාධිකරණය විසින් මෑතකදී ලබාදුන් සුවිශේෂී නඩු තීන්දුවක් (S.C. CHC. Appeal No. 19/2022) ඇසුරින් මෙම වගන්ති ක්රියාත්මක වන ආකාරය පිළිබඳව අප විමසා බලමු.
21 වන වගන්තිය: අනිවාර්ය පූර්ව දැනුම්දීමේ නොතීසිය (Statutory Notice)
ලීසිං පනතේ 21 (1) වගන්තිය ප්රකාරව, වාරික නොගෙවීම වැනි බරපතල ගිවිසුම් කඩකිරීමකදී, ගිවිසුම අවලංගු කිරීමට හෝ සම්පූර්ණ හිඟ මුදල් එකවර ඉල්ලා සිටීමට ප්රථම ලීසිං සමාගම විසින් ලීසිං ලාභියා වෙත ලියාපදිංචි තැපෑලෙන් විශේෂ නොතීසියක් එවිය යුතුය. එම නොතීසියේ පහත කරුණු අනිවාර්යයෙන්ම ඇතුළත් විය යුතුය:
* පැහැදිලිව වැරැද්ද පෙන්වා දීම: ගිවිසුම කඩවීමට හේතු වූ කරුණු (උදාහරණයක් ලෙස පැහැර හරින ලද මාසික වාරික පිළිබඳ විස්තර) එහි නිශ්චිතව සඳහන් කළ යුතුය.
* කාලය ලබා දීම: එම පැහැර හැරීම සකස් කර ගැනීමට (හිඟ මුදල් ගෙවීමට) නොතීසිය ලැබුණු දින සිට අවම වශයෙන් දින 7 ක කාලයක් ලබා දිය යුතුය.
20 වන වගන්තිය: ගිවිසුම අවසන් කිරීම සහ වාහනය පවරා ගැනීම
පනතේ 20 වන වගන්තිය ක්රියාත්මක වන්නේ ඉහත සඳහන් කළ 21 වන වගන්තියේ අවශ්යතා සම්පූර්ණ කිරීමෙන් පසුව පමණි. 21 වන වගන්තිය යටතේ ලබා දුන් නිශ්චිත කාලය ඇතුළත ලීසිංලාභියා හිඟ මුදල් පියවීමට අපොහොසත් වුවහොත් හෝ ඒ සඳහා සාධාරණ හේතුවක් ඉදිරිපත් නොකළහොත් පමණක් ලීසිං සමාගමට:
1. ලීසිං ගිවිසුම අවසන් කිරීමට,
2. වාහනයේ සන්තකය නැවත ලබා ගැනීමට (Repossession),
3. සිදුවූ අලාභයන් අය කර ගැනීමට නීතිමය පියවර ගත හැකිය.

Are Your Lease Payments in Arrears? Know Your Legal Rights Before Your Vehicle Is Repossessed
In the current economic climate, many vehicle owners are experiencing financial difficulties in keeping up with their lease instalments. A common concern is that leasing companies may repossess their vehicles immediately after a few missed payments.
However, under Sri Lankan law, a leasing company cannot arbitrarily terminate a lease agreement or repossess a leased vehicle. The law prescribes mandatory procedures that must be followed before such action can be taken.
The relevant legal provisions are contained in Sections 20 and 21 of the Finance Leasing Act, No. 56 of 2000. Their practical application was recently reaffirmed by the Supreme Court of Sri Lanka in S.C. CHC Appeal No. 19/2022.
Section 21 – Mandatory Statutory Notice
Under Section 21(1) of the Finance Leasing Act, where a lessee commits a material breach of the lease agreement—such as failing to pay the required instalments—the leasing company must first issue a written statutory notice by registered post before terminating the agreement or demanding immediate payment of the total outstanding balance.
The notice must contain the following essential information:
Clear particulars of the default: The notice must specifically identify the breach, such as the instalments that remain unpaid and the amount outstanding.
Opportunity to remedy the default: The lessee must be given a minimum of seven (7) days from the date of receiving the notice to settle the outstanding arrears or otherwise rectify the breach.
Section 20 – Termination of the Lease Agreement and Repossession of the Vehicle
The powers granted under Section 20 become operative only after the requirements of Section 21 have been fully complied with.
If the lessee fails to settle the outstanding amount within the period specified in the statutory notice, or fails to provide a reasonable explanation for the default, the leasing company may then lawfully:
Terminate the lease agreement;
Repossess the leased vehicle; and
Institute legal proceedings to recover any losses or damages arising from the breach of the agreement.
Accordingly, compliance with the statutory notice requirements under Section 21 is a mandatory legal prerequisite before a leasing company may exercise its rights under Section 20.
